By agreeing to these terms, client acknowledges that until sale the is closed, the website and any of it's assets (Visual Assets created by XAV Design, Code, Design, etc.) is property of XAV Design. Any distribution, copying, or unauthorized use is strictly forbidded. Client gains ownership of website source code when the sale is closed. Any website using XAV Design's Hosting or Maintenance services understands that XAV Design reserves the right to remove clients for any reason at any moment. In this event, if the sale has been closed, client maintains ownership of the website and it's contents, however, if the sale isn't closed (is in the "pending" stage) the client must pay

Back-Out Policy: After the inital 50% down payment is made, the payment is non-refundable (Exceptions include: XAV Design canceling the project with no XAV Design Guideline Violation by the client. )
